STATE SPECIFIC REQUIREMENTS
- Designated Producers: May not apply for a license if they have previously
held the license in NY. Company appointments will no longer be required
before NY can issue a Life Agent or Property Agent license. Sponsoring
Insurance companies have 15 days from the date the agency contract is
executed or the first insurance application is submitted.
- NRL Applicants – If you previously held a license, resident or
non-resident, in the state of New York, you will need to send a paper
application to the state at this time. If you are not sure if you ever had a
license in NY, please contact the NY Dept of Insurance to verify. http://www.dfs.ny.gov
- Background Questions: Applicants answering "yes" to one or more
of the background questions may be required to provide additional
information to the Department. You will be notified by mail of what to send
and where to send it. Please do not forward any documents until you receive
a request from the Department.
- Licenses will be issued with an expiration date determined by date of birth:
- If you were born in an even numbered year, your license will expire on your birthday in an even numbered year.
- If you were born in an odd numbered year, your license will expire on your birthday in an odd numbered year
- If applicant was born in an even year and applies PRIOR to their birthday in an even year, expiration will be in the same year as application. If applicant applies AFTER birthday in an even year, applicant will be issued a full cycle license. If applicant applies in an odd year and was born in an even year, expiration date will be issued on the date of birth on the following year.
Ex: Birth Date 06/19/1976 - applicant applies 04/15 /2010, applicants expiration will be 06/19/2010.
Ex: Birth Date 06/19/1976 - applicant applies 07/15/2010, applicants expiration will be 06/19/2012.
Ex: Birth Date 06/19/1976 - applicant applies 08/15/2011, applicants expiration will be 06/19/2012.
- An accepted response on a transaction where the applicant has answered yes to a background question for NY, does not mean the application has been approved by the state. An accepted response means the transaction has successfully loaded into the states system for further review. Once NY has completed any investigation that is necessary, a decision will be made on the application. Applicants will be receiving a notice from NY for supporting documentation needed.
- In New York State, AGENT is a producer who represents one or more insurers and sells insurance to the public on behalf of that insurer(s). In order for the agent to sell insurance, an insurer(s) must have appointed the agent.
- In New York State, BROKER is a producer who represents the public and will do business with any New York licensed insurer which will do business with a broker. Brokers are not required to have an insurer appointment on file
- When attempting to access licensing applications, please include the alpha characters ('LA-','PC-','BR-' etc) in front of the NY license number.
State fees will not be collected by NIPR (on behalf of NY) when a transaction is
declined according to NY business rules. Transaction fees and processing fees
will still apply. Violation of the following rules will result in a decline
response.
- Applicant must not have an inactive Non Resident
license in NY.
- Applicant must not have an inactive Resident
license in NY.
- Individual applicants - Applicant must be 18 years old or older as
determined from the applicant's Date of Birth.
- In NY, the property/casualty lines of authority on a broker license are - property, casualty, personal lines and baggage. However, Section 2104 (B) of the NY Insurance Law states that a broker with the property casualty lines of authority is authorized to write any and every line of authority except life insurance and variable life and variable annuity products.
In New York there are two different types of broker: Property/Casualty Broker and Life Broker.
- A Property/Casualty Broker would be authorized to write all lines of insurance except life and variable annuities.
- A Life Broker could be authorized to write life and/or accident/health and or variable annuities. The lines of authority are determined by the qualifications.
As soon as the license is issued, the applicant will have 10 days to electronically print the license by accessing the Department's website at http://www.ins.state.ny.us/services.htm. If the license is not
electronically printed within the 10 days, a paper license will automatically be generated and mailed. Once the license is generated and mailed, a $15.00 duplicate license fee will be charged to any future license print requests.
