State Specific Individual Requirements
Every individual applicant for a Minnesota Resident insurance producer license must meet the following requirements:
- Applicant must be 18 years old or older as determined from the applicant's Date of Birth.
- If making application to "Surplus Lines" license class, applicants must already hold Property and Casualty on MN "Producer" license.
- Applicant Business E-Mail Address must be entered
- Surplus Lines Applicant must hold active Property AND Casualty lines in MN
- Amendments are allowed if applicant has an active state resident license.
- Applicant can only amend for LOA's not already active.
- If license type is Producer and the LOA's date status effective is greater than 1 year or if inactive for any reason other than Failure to Renew, applicant should be able to apply for a new license through RL.
- Technology Fee - The 2007 Legislature passed a provision that requires many applicants for licensure and current licensees to pay up to a $25.00 fee to cover the costs associated with implementing the Department's electronic licensing systems. This new legislation affects Insurance Producers, Public Adjusters and Independent Adjusters and is added to the total cost of the license or license renewal. In return for paying the technology fee, insurance producers and their education providers will no longer have to pay on a per transaction basis to use many of the online services such as printing a license, requesting letters of certification, making address or name changes, etc.
- An OET Surcharge is charged to License classes that are not already charged the Technology Fee and is added to the total cost of the license or license renewal. The OET fee is 10% of the original license fee with a minimum fee of $5.00 to a maximum of $150.00. Example: The License fee is $200.00 + OET fee is $20.00 and the total fee charged is $220.00.
- State fees will not be collected by NIPR (on behalf of MN) when a transaction is declined according to MN business rules. Transaction fees and processing fees will still apply. Violation of the following rules will result in a decline response.
- A Catastrophe Adjusters license is active for 6 months. Catastrophe Adjusters may extend their license for an additional 6 months if done so before the end of the first 6 months.
- TENNESSEN WARNING On your application, the Minnesota Department of Commerce will ask you for information, like your Social Security number, that is classified as "private data" under the Minnesota Government Data Practices Act (Minnesota Statutes, chapter 13). The Data Practices Act requires any governmental entity asking an individual to supply private data to inform the individual of:
(a) the purpose and intended use of the requested data;
(b) whether the individual may refuse to supply the requested data or is legally required to supply it;
(c) any known consequence of supplying or refusing to supply private data; and
(d) the identity of other persons or entities authorized by state or federal law to receive the data.
The information contained in (a)-(d) is called a "Tennessen Warning" and is set forth below. The Tennessen Warning also satisfies the federal notice requirement under 5 U.S.C. 552a Note, which is triggered by our request for your Social Security number in the application.
If the Commissioner of Commerce issues a license to you, all information contained in your application, except your Social Security number and nondesignated addresses, will be public pursuant to Minnesota Statutes, section 13.41, subdivision 5.
- Tennessen Warning - Individual
(a) Purpose and Intended Use of the Data
The data you give us about yourself is needed to:
a) identify you;
b) enable us to contact you when required;
c) assist us in determining your qualifications and eligibility for the license you are applying for;
d) comply with certain federal and state reporting requirements; and
e) evaluate the administration and management of this licensing/registration program.
(b) Disclosure: Mandatory or Voluntary?
You are legally required to supply all of the data required on the Uniform Application pursuant to Minnesota Statutes, section 60K.37, subdivision 2 (if you are a producer) or Minnesota Statutes, section 72B.04, subdivision 3 (if you are an adjuster). In particular, you must provide your Social Security number pursuant to 42 U.S.C. 666(a)(13) and Minnesota Statutes, section 270C.72, subdivision 4. You are not legally required to supply any other data requested on the application.
(c) Consequences of Supplying or Refusing to Supply Requested Data
If you supply all of the requested data, your application will be processed. If you refuse to supply data requested on the application, your application will not be processed. Whatever information you do supply to the Department will be maintained by us, whether or not your application is approved.
(d) Others Authorized to Receive the Data
The information about you that is collected on the application will be classified as either public or private data. Public data will be accessible to the public. Private data about you will be accessible only to:
a) you;
b) state personnel who determine your eligibility for licensure;
c) employees of license database vendors;
d) the Minnesota Department of Revenue (Minnesota Statutes, section 270C.72, subd. 4);
e) the public authority responsible for child support in Minnesota (Minnesota Statutes, section 256.978);
f) any appropriate person(s) or agency, if the Commissioner of Commerce determines that failure to make the data accessible is likely to create a clear and present danger to public health or safety;
g) person(s) authorized by a court order; or
h) any other person authorized by state or federal law.
State Specific Business Entity Requirements
Every business entity applicant for a Minnesota Resident insurance producer license must meet the following requirements:
- Applicants applying for Indv Prop Agency must choose ""Sole Proprietor"" as the Agency type to be able to apply for this class.
- At least one Designated/Responsible Licensed Producer must be entered.
- The Designated/Responsible Licensed Producer must hold an active license in MN at the time the business application is submitted. The active license may be either resident or non-resident.
- At least one of the entities listed for an Owner, Partner, Officer, or Director must be an individual.
- Applicant Business E-Mail Address must be entered

- Applicant applying for Res Independent Adjuster or Res Public Adjuster may reinstate their inactive license up to 1 year past their expiration date of the LOA Status Date as long as LOA status reason is one of the following: Failure to Renew and Suspended for Education.
- Resident Crop Hail Adjuster and Resident Public Adjuster Solicitor may reinstate their inactive license up to 1 year past their expiration date of the LOA Status Date as long as LOA status reason is Failure to Renew.
- Res Independent Adjuster and Res Public Adjuster applicants must apply as new the day after the expiration date as long as license is inactive with any status reason other than: Failure to Renew and Suspended for Education.
- Resident Crop Hail Adjuster and Resident Public Adjuster Solicitor applicant must apply as new the day after the expiration date as long as license is inactive with any status reason other than Failure to Renew.
- Crop Hail Adjuster, Resident Public Adjuster Solicitor, Res Independent Adjuster, and Res Public Adjuster applicants may not reinstate their license if license is active and past their expiration date.
- Resident Crop Hail Adjuster, Resident Public Adjuster Solicitor, Res Independent Adjuster, and Res Public Adjuster licenses that are one year or more past license expiration date must apply as new through RL.
- Catastrophe Adjusters do not renew.

e) evaluate the administration and management of this licensing/registration program.
(b) Disclosure: Mandatory or Voluntary?
You are legally required to supply all of the data required on the Uniform Business Entity Application pursuant to Minnesota Statutes, section 60K.37, subdivision 3. In particular, you must provide your Minnesota business identification number pursuant to Minnesota Statutes, section 270C.72, subdivision 4. You are not legally required to supply any other data requested on the application.
(c) Consequences of Supplying or Refusing to Supply Requested Data
If you supply all of the requested data, your application will be processed. If you refuse to supply data requested on the application, your application will not be processed. Whatever information you do supply to the Department will be maintained by us, whether or not your application is approved.
(d) Others Authorized to Receive the Data
The information about you that is collected on the application will be classified as either public or private data. Public data will be accessible to the public. Private data about you will be accessible only to:
a) you;
b) state personnel who determine your eligibility for licensure;
c) employees of license database vendors;
d) the Minnesota Department of Revenue (Minnesota Statutes, section 270C.72, subd. 4);
e) the public authority responsible for child support in Minnesota (Minnesota Statutes, section 256.978);
f) any appropriate person(s) or agency, if the Commissioner of Commerce determines that failure to make the data accessible is likely to create a clear and present danger to public health or safety;
g) person(s) authorized by a court order; or any other person authorized by state or federal law.
